My Mitsubishi Paint Problems

Wear and Tear at its Best!

Wednesday, June 2, 2010

Well Mitsubishi settled today and everyone save the original plaintiff on the class action and the lawyer got fucked in the ass. I’m pissed and I wasn’t even covered by the lawsuit. Well now that they’ve settled I’ll take them to court up here and see what I can get from them.

Roy Katriel made off with over $700,000 in fees and the average owner of a Mitsu car got under $500. Fuck you Roy, you stupid fucking shit. I just checked Google and I’m the number 2 hit for Roy Katriel (at least for google.ca) thats awesome. Don’t use Roy!

Anyway, heres the shitty settlement this jackoff “won” for the people wronged by Mitsubishi’s shitty products.

So again folks, if you want to get screwed, join a class action run by this guy.

Just a quick point

I see a lot of people who try to make comments but the captcha stops them. I apologize for it, but if it wasn’t there I’d have about 500 comments a day trying to sell you Russian viagra. Even with the captcha some get through, be careful if you click a link someone leaves, I remove them as quickly as I can.

Response from Mitsubishi Canada

Typical “Your warranty is expired” BS. Ignored my question about Mitsu Canada following suit in admitting something is wrong.

There is good news though! A Mitsubishi dealership just opened in my town. Maybe it’s time to slip some business cards with the website’s url into a few visors while I “look at cars”.

So apparently the garbage below was accepted…

I’ve got an email from someone involved saying the $1200 crap was accepted by the court. This is incredible to me as I was quoted $6,000 by Mitsubishi. Settlement paperwork is apparently going out shortly Of course it’s nothing for me, since I’m in Canada. So I’ve sent them a message!

Hello Mitsubishi Canada!

Not sure if you are aware, but Mitsubishi Motors of America (of which you are a subsidiary) has recently settled a class action lawsuit in the United States for the paint delamination problem of which I complained about over 4 years ago. At that time I was told that I caused the problem by your incredibly ignorant staff. Will Mitsubishi Canada be doing anything to compensate Canadian owners as your parent company has now admitted that it is your issue? I eagerly await your response!

Every other time I’ve emailed them I’ve gotten comments on the site telling me to take my business else where…lets see if I get them from their fine staff again!

Read me!

If you think the settlement is a load of horse shit, which it is. Follow the directions at this link:

Here

This settlement is so unbelievably fucked, I recommend everyone that has been screwed by Mitsubishi to write and tell the court how fucked it really is.

More info on the lawsuit

Go here:
http://www.mitsubishiblackpaintsettlement.com/

It was set up by the settlement administrator. In the meantime I’d like to encourage Mitsubishi to shove this offer up their asses.

So I was thinking….

This proposed settlement…it’s based off how much Mitsubishi says it would cost to repair it. Since I have a quote from Mitsubishi stating that it would cost $6000 to repair it, would that not entitle me to 40% of that $6000?

How much is Roy Katriel getting from this suit?

So the “law firm” that is dealing with this class action suit feels that this is the best option for settlement. I’m questioning the abilities of these lawyers. Do they know how much money it costs to paint a car? Hell I’m not even covered by the Class Action and I’ve spent more trying to get this resolved then what they are offering.

TABLE 1: VEHICLES THAT WERE SUBJECT TO A 3 YR/36,000 MILE WARRANTY

TIME OUT OF WARRANTY AND TOTAL MILEAGE PERCENT OF ACTUAL PAINT COST TO BE COVERED BY DEFENDANT MAXIMUM CAPPED CASH REIMBURSEMENT FOR REPAINT COSTS
1 day < 1 year and < 48,000 miles 75% $800
>1 year but < 2 years, and < 60,000 miles2 70% $700
>2 years but < 3 years, and < 72,000 miles 60% $600
>3 years but < 4 years, and < 84,000 miles 50% $500
>4 years but < 5 years, and< 96,000 miles 50 % $400
>5 years but < 6 years, and< 96,000 miles 50 % $300
> 6 years but < 7 years, and unlimited mileage 40% $300

TABLE 2: VEHICLES THAT WERE SUBJECT TO A 5 YR/60,000 MILE WARRANTY

TIME OUT OF WARRANTY AND TOTAL MILES PERCENT OF ACTUAL PAINT COST TO BE COVERED BY MITSUBISHI MAXIMUM CAPPED CASH REIMBURSEMENT FOR REPAINT COSTS
1 day < 1 year, and < 72,000 miles 60% $600
>1 year but < 2 years, and < 84,000 miles 50% $500
>2 years but < 3 years, and < 96,000 miles 40% $400

If you are a Mitsubishi owner covered by the lawsuit, I urge you to call, email or show up at the Katriel Law Firm and voice your displeasure. I’d be curious to know how much he made off this suit.

Class Action Information

This information was all found online in 5 minutes!

SACV 08-00650-JVS(RNBx): Vizzi v. Mitsubishi Motors North America, Inc.

And it’s being presided by HONORABLE JAMES V. SELNA, U. S. DISTRICT JUDGE

The two lawyers representing the car owners are

Michael Braun
Roy Katriel

Mitsubishi’s lawyers are:

Andrew Carpenter acarpenter@shb.com
Douglas Robinson dwrobinson@shb.com
Eva Weiler   eweiler@shb.com

of the Shook, Hardy and Bacon firm, which is a delicious sounding firm.

Edit: I do not endorse, not recommend emailing the lawyers for Mitsubishi.
